A general template, not legal advice

This is a general template, not legal advice. Expense reimbursement, payroll tax registration and workplace rules depend on the state where the employee works, which may not be the state of your office. Have a lawyer or payroll provider check the agreement for an employee in another state.

How to use it

Type the company and the employee, choose hybrid or fully remote, and set the start date and the notice period for ending the arrangement. Write the schedule with in-office days and core hours, the home address the employee works from, the equipment you provide one item per line, and any internet or phone stipend. These print in a box at the top; the numbered terms below cover availability, location changes, overtime, equipment, expenses, safety, security and how to end the arrangement.

Both sides sign and keep a copy. Choose Hide under Signature lines if you sign in an e-signature tool.

Things to watch

The employee's location matters more than the office address: if someone works from another state, you may need to register for payroll taxes there and follow that state's wage rules. Non-exempt remote workers must be paid for all time worked, including after-hours messages, so set clear expectations about when they log off.

Frequently asked questions

Does remote work change the employment terms?

Not under this agreement. Pay, benefits, duties and policies stay the same, and employment remains at will. The agreement only sets where and when the work is done and who pays for what.

Do I have to pay for an employee's home internet?

Federal law does not require it unless the cost pushes a worker below minimum wage. Some states, California among them, require employers to reimburse necessary business expenses, which can include part of a home internet or phone bill. A monthly stipend is a common way to handle it.

Which state should I pick for governing law?

Usually the state where the work is done or where both parties live. If you are in different states, pick one you both accept and that a lawyer can advise on. Leaving it blank prints a line to fill in by hand.

Is what I type saved anywhere?

No. Everything stays in your browser and nothing is sent to our server. If you refresh the page it is gone, so print, save a PDF or download the DOCX when you are done.
