State rules vary

State rules on final pay and notice vary. Check your state labor department. Some states require the final paycheck on the last day, others within a set number of days, and a few require written notice of the reason.

How to use it

Record the incident first: who, when, what happened and which rule it broke, in time order. Add witnesses by name and role, and any earlier actions as date | action | by so the table shows the progression. Then pick the action taken; for a suspension, type the number of days and it prints in the check line. The employee statement box stays empty for the meeting.

Meet the employee in private with an HR representative when possible, read the form together, let the employee write their statement, and collect the three signatures. Give the employee a copy. For a written or final warning, pair this form with the written warning letter; for a termination, use the termination letter as well.

Things to watch

Apply the same action to the same conduct across employees; the prior actions table helps you check. Unpaid suspensions for salaried exempt employees can affect their exempt status under federal wage rules, so ask HR or payroll before suspending an exempt employee without pay. Unionized workplaces follow the grievance steps in the contract.

Frequently asked questions

What is the difference between this and an employee write-up?

A write-up documents one incident and the conversation about it. This form adds the formal decision: which disciplinary step was taken, from a verbal warning to termination, with the effective date and an HR signature.

Can I suspend without pay?

For hourly employees, usually yes, subject to your policy and any contract. For salaried exempt employees, unpaid suspensions are limited under the federal rules on the salary basis, so check with HR first.

Does the employee have to write a statement?

No. Offer the space and the chance to attach a written response later. If they decline, note it in the box.

Is what I type saved anywhere?

No. Everything stays in your browser and nothing is sent to our server. If you refresh the page it is gone, so print, save a PDF or download the DOCX when you are done.
